Terms and Conditions

When you use any services provided by Elyse Anne Marr ABN 51 281 658 427 trading as Positive Pups Training, its employees or agents (“Positive Pups Training”), you agree to the following terms and conditions.

1. Health

You agree to express, in writing, any known or suspected behavioural or aggression problems that your dog has. You are solely responsible for any harm or injury caused by your dog while in the care of Positive Pups Training.

Positive Pups Training accepts no liability for uninsured dogs and strongly recommends that your dog is insured prior to attending any sessions.

You agree that, at the time of each session, your dog will be:

- fully vaccinated;
- wormed at regular intervals;
- in good health; and
- micro-chipped and with registration details up to date

You must provide proof of the above at the request of Positive Pups Training.

Under no circumstances will Positive Pups Training be held responsible for any Paralysis Tick, Canine Influenza, Injury, Death, Loss or Damages of any kind whatsoever that may occur to any dog while in the care of Positive Pups Training.

Should any dog become ill or injured while with Positive Pups Training, Positive Pups Training reserves the right to administer necessary aid, and, if necessary, transport the dog to a veterinarian. Any expenses incurred are your responsibility. Positive Pups Training will attempt to contact the dog’s own veterinarian but reserves the right to transport the dog to another veterinarian if necessary.

It is your responsibility to ensure the health of the dog is verified by a veterinarian to ensure there are no underlying health issues before a session is undertaken. If any dogs are observed to appear unwell when presenting to a session, you may be asked to reschedule your session. Make up sessions may not be able to be provided for group sessions and fees for the missed session may be forfeited.

If your female dog has gone into heat while taking part in a course, you will be able to postpone your remaining sessions to a later course or a refund will be provided if no other course is available. However, if you have booked into a course knowing you cannot attend a week for another reason such as a holiday or other event, a substitute course may not be able to be offered in its place and your fees will be forfeited.

2. Environment

Positive Pups Training will endeavour to create as safe an environment as possible for the training of your dog.

You acknowledge that Positive Pups Training will allow dogs to play and interact directly with one another off leash and in public spaces, and that this open and uncontrolled environment may lead to injuries. You authorise Positive Pups Training to muzzle your dog if Positive Pups Training deem, at its absolute discretion, that the dog is showing signs of aggression. Further, you agree to release and indemnify Positive Pups Training from and against all liability in connection with any claims of injury, expenses, costs, or damages howsoever caused during the provision of services by Positive Pups Training or while your dog is in the care of Positive Pups Training including, but not limited to, claims arising from the actions of third parties in public spaces.

You accept that participating in an activity with dogs, children and adults poses a potential risk of injury to yourself and your dog, and you agree to indemnify Positive Pups Training for all personal injury and damage to property owned by you while attending the training classes. You also agree to make any person who accompanies you to the class aware that they are also there at their own risk.

If you attend classes with children or a child is present within the session, supervision and safety of the child is the responsibility of the parent or guardian. Young children may be at a greater risk of being harmed by dogs, especially those they are unfamiliar with. If you attend classes with small children, we ask that you supervise them carefully and do not allow them to interact with other dogs in the class. If you do allow interactions between a child and other dogs, any harm or injury is not the responsibility of Positive Pups Training.

All instances of accident or injury must be reported to the instructor, immediately, at the time they occur.

Positive Pups Training will not be held liable for any injuries that may occur as a result of any non-trainer facilitated interactions that occur within the training facility property or outside of training sessions. You agree to indemnify Positive Pups Training from any liability to claims, losses, fees or suits that may arise from any information received during sessions.

3. Bookings and Cancellation

No bookings are confirmed until a member of Positive Pups Training has contacted you in writing to confirm the booking. This may be by SMS or email.

You are required to pay the full amount of the course or session at the time of booking. Failure to pay in advance may result in your spot being given to another customer.

Any bookings cancelled less than 24hrs before the commencement session will be charged at the full rate to cover the reasonably anticipated costs of Positive Pups Training associated with the cancellation.

Bookings cancelled more than 24hrs before the session will be rescheduled at no cost to you. Refunds will only be available for sessions cancelled by Positive Pups Training. Positive Pups training reserves the right to cancel a session for any reason.

It is your responsibility to ensure that Positive Pups Training has access to your dog at the time of the sessions. If Positive Pups Training are unable to gain access to the dog, the session will be charged at the full rate.

4. Promotion

You consent and agree that Positive Pups Training have the right to take photographs, videotape, or digital recordings of yourself, your family members and your dog during sessions, and to use these in any and all media, now or hereafter known, and exclusively for the purpose of marketing and education.

You hereby release to Positive Pups Training, its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately for use online and in their marketing and educational collateral. You also waive any rights, claims, or interest you may have to control the use of your identity or likeness in whatever media used.

You understand that there will be no financial or other remuneration for recording yourself, family members or pets, either for initial or subsequent transmission or playback. You also understand that Positive Pups Training is not responsible for any expense or liability incurred as a result of your participation in this recording, including any medical expenses due to any sickness or injury incurred as a result.
